FULTON, Mo. - A former officer at the Callaway County Jail pleaded guilty Monday to a charge of third-degree assault after using pepper spray on an inmate.
J.D. Nodine, 31, of New Bloomfield, agreed to a plea bargain and was found guilty of the charge and fined $300 plus court costs. The case was slated for a jury trial Thursday, but was closed after Nodine and his attorney reached an agreement with the state counsel, Special Prosecutor Robert Ahsens, during a pre-trial conference.
Nodine was charged with assault after he sprayed a prisoner in the eyes with pepper spray on Oct. 26, 2010. According to statements made to the Fulton Police Department by the inmate, he was sprayed in the eyes for no reason after being brought to the jail. Nodine was arrested on Jan. 1.
