No charges in St. Louis home-defense shooting

June 9th, 2011 in News

ST. LOUIS (AP) - Prosecutors in St. Louis have declined to charge two people arrested for fatally shooting a man who had broken into a home.

Authorities decided the shooting was justified under Missouri's "castle doctrine." The 2007 law gives Missouri residents a right to defend themselves and their property. It says there is no duty to retreat from a home or vehicle if an intruder enters illegally.

Police say Emmett Terry was shot to death April 6 after breaking into his ex-girlfriend's home and trying to attack her. Police had arrested a 29-year-old woman who had a restraining order against Terry. They also had arrested a 37-year-old man. Neither will be charged. Authorities say the woman fired the shots.
