Family sues nursing home over wrongful death

A Russellville man last month sued a Jefferson City nursing home after his mother died last August after an apparent assault, claiming the home was both negligent and violated state law in his mother's care.

"The Estate of Mildred Russell is entitled to actual economic and non-economic damages as a result of the deprivation of rights guaranteed by (state law), including but not limited to the pain, suffering, humiliation, anxiety, and death of Mildred Russell," son David Russell argued in a lawsuit filed Dec. 29 in the Cole County Circuit Court, against the Adams Street Place Nursing Home, 1024 Adams St.

"The deprivation of rights complained of is the result of an intentional act or omission by the Defendant," the suit argued. "While Mildred was a resident of the ... facility, Defendant, and its employees and agents, had a duty to use reasonable care to protect and care for Mildred; including keeping her safe from physical assault and neglect by others."
