Missouri AG sues telemarketer for no-call list violations

Missouri Attorney General Eric Schmitt announced Wednesday that his office has filed a lawsuit against a Florida-based business for violations of Missouri's No-Call Law and Missouri's Telemarketing Practices Law.

The lawsuit alleges Allied Health Supply LLC and its president, Claudia Sullivan (aka Claudia Ledesma), called Missouri residents who were on the no-call list offering orthopedic braces.

Schmitt said in a news release that consumers were defrauded and their insurance and Medicare were billed for devices they didn't order or need.

According to the suit, callers for the company implied they were with Medicare and the equipment was a new benefit the residents would qualify for.

The Attorney General's Office received 99 complaints from residents statewide about Allied Health. Additionally, call records show more than 400,000 calls were made to Missouri residents on the no-call list. The call records also reportedly confirm several complaints of the harassing nature of Allied's calls, including one individual who received 90 calls in a 14-day period and several other individuals who received more than 10 calls in a single day.

In his suit, Schmitt is asking that the company and Sullivan be kept from making any further calls. He is also seeking penalties and recouping costs of the investigation as well as prosecution of the case.
