Several cases passed through Callaway County circuit court

The following cases were heard Feb. 14 in the Circuit Court of Callaway County, Division III, Honorable Kevin Crane presiding:

Malik Clark, 20, of Fulton, pleaded guilty to possession of a controlled substance (marijuana) with intent to distribute. Clark admitted he possessed approximately 15 grams of marijuana in 12 individually wrapped baggies when he was stopped for a traffic offense in March 2016. Clark told the judge he intended to distribute the marijuana to others. The judge placed Clark on five years of supervised probation and ordered him to complete the Callaway County Drug Court program. The case was investigated by the Fulton Police Department.

Cecil Cole, 41, of Florissant, failed to appear in court, and a warrant was issued for his arrest.

Curtis Emily, 38, of Moscow Mills, pleaded guilty to felony stealing and was sentenced to four years in prison. Emily admitted he shoplifted from a Fulton business in July 2016. The offense was enhanced to a felony based on his convictions for stealing in Callaway and Montgomery counties in 2013. The judge suspended execution of the prison sentence and placed Emily on five years of supervised probation. The case was investigated by the Fulton Police Department.

Austin Halsey, 20, of Kingdom City, pleaded guilty to the felony offense of resisting a lawful stop. Halsey admitted he failed to stop when a deputy attempted to stop him for a traffic offense in October 2015. He fled from the officer, traveling at speeds in excess of 90 mph with a passenger in his vehicle. The judge placed Halsey on five years of supervised probation. The case was investigated by the Callaway County Sheriff's Office.

Derek Hawes, 42, of Holts Summit, pleaded guilty to possession of a controlled substance (methamphetamine) and was sentenced to four years in prison. Hawes admitted he possessed the drug when he was stopped for an equipment violation in March 2014. The judge suspended execution of the prison sentence and placed Hawes on five years of supervised probation. The case was investigated by the Callaway County Sheriff's Office.

Troy Hodges, 35, of Fulton, failed to appear in court, and warrants were issued for his arrest.

Gary Kidwell, 36, of Vienna, pleaded guilty to possession of a controlled substance (methamphetamine) and was sentenced to five years in prison. Kidwell admitted he possessed the drug when he was arrested on an unrelated traffic offense in June 2016. The case was investigated by the Fulton Police Department.

Brandon Lewis, 33, of Jefferson City, pleaded guilty to driving while revoked (fourth offense) and was sentenced to three years in prison. Lewis admitted he was operating a vehicle on U.S. 54 in March 2016 when his driver's license was revoked. The offense was enhanced to a felony based on his three prior convictions for the same offense. The judge suspended execution of the prison sentence and placed Lewis on five years of supervised probation. The case was investigated by the Missouri Highway Patrol.

Sylvester Vernell, 49, of Jefferson City, pleaded guilty to possession of a controlled substance (methamphetamine) and was sentenced to four years in prison. Vernell admitted he possessed the drug when he was arrested on unrelated charges in January 2016. The case was investigated by the Callaway County Sheriff's Office.

The following cases were heard on Feb. 21 in the Circuit Court of Callaway County, Division I, Honorable Christine Carpenter presiding:

Christopher James Allen, 19, of Nashville, Tennessee, pleaded guilty to committing violence against an offender in the Department of Corrections and was sentenced to 15 years in prison. Allen admitted he assaulted another inmate at the Fulton Reception and Diagnostic Center in June 2015 when the two were incarcerated at that institution. The victim suffered several facial fractures as a result of the attack. The case was investigated by the Missouri Department of Corrections.

Makayla Boutelle, 19, of Holts Summit, pleaded guilty to first-degree child molestation and second-degree child molestation. Boutelle admitted she had subjected a 12-year-old and 14-year-old to sexual contact in late 2014. Boutelle was 17 at the time of the sexual contact. The judge placed her on five years of supervised probation for first-degree child molestation, a felony offense, and sentenced her to 90 days in jail for second-degree child molestation, a misdemeanor offense. Boutelle will be required to register as a sex offender. The case was investigated by the Callaway County Sheriff's Office.

Mellisa Cayce, 39, of Fulton, pleaded guilty to possession of a prohibited article in a county jail and was sentenced to seven years in prison. Cayce admitted she possessed methamphetamine in the Callaway County Jail in September 2016, and she possessed the drug in the jail after she had been arrested on an unrelated warrant from Cole County during a traffic stop. The case was investigated by the Callaway County Sheriff's Office.

Kayla Cox, 25, of Kansas City, pleaded guilty to possession of a controlled substance (dextroamphetamine). Cox admitted she possessed the drug when she was stopped for a traffic offense in August 2015. The judge placed her on five years of supervised probation. The case was investigated by the Missouri Highway Patrol.

Kevin Hill, 50, of Springfield, failed to appear in court, and a warrant was issued for his arrest.

Weston Kinsey, 29, of Springfield, was sentenced to five years in prison for committing violence against an offender in the Department of Corrections. Kinsey had been on probation for the offense, admitted violating probation, and the judge revoked it. The case was originally investigated by the Missouri Department of Corrections.

Seth Macvittie, 36, of Fulton, pleaded guilty to possession of a prohibited article in a correctional facility and was sentenced to five years in prison. Macvittie admitted he possessed a sharpened metal rod, intended as a weapon, while he was incarcerated at the Fulton Reception and Diagnostic Center in February 2016. The judge ordered him to serve the five-year sentence consecutive to the 20-year sentence he is presently serving. The case was investigated by the Missouri Department of Corrections.

Danel Thomas Pittman, Jr., 24, of Fulton, pleaded guilty to sale of a controlled substance (cocaine) and was sentenced to seven years in prison. Pittman admitted selling the drug to a confidential informant in April 2015 during an undercover drug operation. The case was investigated by Mustang and the Callaway County Sheriff's Office. He was also sentenced to seven years in prison on an unrelated charge of possession of a controlled substance (crack cocaine) with intent to distribute. Pittman had been on probation for that offense, admitted violating probation by committing the new offense, and the judge revoked probation and imposed a seven-year prison sentence. In both cases, the judge recommended he complete a substance-abuse treatment program within the Department of Corrections before being considered for release.

Travis Terry, 34, of Columbia, pleaded guilty to possession of a controlled substance (cocaine), unlawful use of a weapon and driving while intoxicated. Terry admitted he was under the influence of alcohol when he crashed his vehicle on Route KK last April. No other vehicles were involved in the crash. Officers discovered cocaine and a pistol in his vehicle during the investigation of the crash. The judge placed Terry on five years of supervised probation for the drug and weapon offenses and sentenced him to 30 days in jail for the DWI. The case was investigated by the Callaway County Sheriff's Office and Missouri Highway Patrol.

Mikeal Tice, 24, of Columbia, pleaded guilty to resisting a lawful stop and driving while revoked and was sentenced to four years in prison on each charge. Tice admitted he fled from a deputy sheriff who attempted to stop him in November 2016 for a traffic offense. He refused to stop for the officer, and a pursuit ensued lasting several miles in which Tice traveled at speeds in excess of 100 mph, drove into oncoming lanes of traffic, failed to stop at a stop sign and nearly struck another motorist. Tice admitted his driver's license was revoked at the time of the offense. The case was investigated by the Callaway County Sheriff's Office.

Bryan Turner, 27, of Springfield, failed to appear in court, and a warrant was issued for his arrest.

Joseph Underwood, was sentenced to five years in prison for possession of a controlled substance (methamphetamine). Underwood had been on probation for the offense, admitted violating probation, and the judge revoked it. The case was originally investigated by the Holts Summit Police Department.

Wesley Yanacheak, 23, of Fulton, failed to appear in court, and warrants were issued for his arrest.
