JC man pleads to amended charge in attack on disabled man

A Jefferson City man charged with trying to harm a paralyzed man in May has pleaded guilty to an amended charge.

Associate Circuit Judge Tom Sodergren accepted the plea of Brian Conley, 56, of 212 Riverside Drive, who pleaded guilty to a misdemeanor charge of first-degree trespassing.

He had been charged with felonious restraint.

Conley was ordered to serve 30 days in jail, but was given credit for 30 days already served. He must also pay $1,851 in fines and court costs within 30 days.

A Cole County Sheriff's Department probable cause statement shows Conley was at a residence in the 5600 block of Heritage Highway when the incident occurred.

Deputies had received a call from the victim's mother saying she had gotten a call indicating her son needed help and someone was hurting him.

When deputies got on the scene, Conley was found to be drunk and belligerent.

While deputies were talking to Conley, the victim, according to the statement, used hand signals to give the Morse Code distress signal, while trying to keep Conley from noticing.

The victim told deputies he and Conley had been drinking on a couch and, at one point, Conley grabbed the victim, pulled him over and attempted to rape him.

The victim tried to call his mother, but Conley took the phone away and hung it up.

The victim said Conley wouldn't let him leave and threatened physical violence against him if he tried to get help.
