Missouri man convicted of wife's death gets legal victory

TROY, Mo. (AP) - A man serving a life sentence for killing his wife in 2011 has won a legal victory in his quest for a retrial.

The St. Louis Post-Dispatch (http://bit.ly/17VgocQ) reports that the Missouri Court of Appeals on Tuesday sent Russell Faria's case back to the trial court for a hearing on a retrial motion.

The appellate court ruled that newly discovered evidence could produce a different outcome at a new trial.

Faria is serving his sentence of life without parole. Prosecutors say he stabbed his wife, Betsy Faria, 55 times in December 2011.

But Faria, his lawyers and his alibi witnesses have long argued that he was miles away when his wife died.
