Robbery-beating trial postponed

The jury trial for Pamela Carter, the Fulton woman accused in the robbery and beating of a stranger leaving the Fulton Walmart in October 2012, has been delayed to give attorneys more time to issue a subpoena to an out-of-state witness.

"We had an issue with an out-of-state witness who was going to have a problem getting to court, and (with) the state we were looking at, it was going to be an issue to get them served with a subpoena in that state," said Callaway County Prosecuting Attorney Chris Wilson. "We had not requested a continuance and when we learned of this problem did what we could as quickly as we could to resolve it but frankly could not get it accomplished, and the Thanksgiving holiday made it even more of a problem so we asked the judge for a continuance."

Online records at Missouri Case.net state the Callaway County Prosecuting Attorney said the trial, set to begin this week, was delayed as a subpoena was not served to Dr. Christopher Nelson.

Wilson said the continuance was issued by Judge Gary Oxenhandler, who was sitting in for Judge Kevin Crane. The defense and prosecution are working to figure out a list of agreeable dates for the continuance before the judge will select one.

A subpoena cannot be sent until there has been a determined court date.

Carter, 58, was arrested and charged with robbery and assault charges after she allegedly followed Sara L. Spencer of Fulton to her car from Walmart, forced her to withdraw money from her bank account, beat her and left her in a ditch off of a rural county road.
