MOSIRA is unconstitutional, at least as lawmakers passed it during last fall’s special session, Cole County Circuit Judge Dan Green ruled Monday evening.
In an 11-page ruling, Green prohibited Gov. Jay Nixon’s administration “from taking any action, including but not limited to the use of public funds, to implement or otherwise effectuate any provision” of the law known as the “Missouri Science and Innovation Reinvestment Act.”
Green also ordered Nixon, Attorney General Chris Koster and others “to rescind all actions taken to implement or otherwise effectuate any provision of” the law.
Although no one was available Monday evening to provide a reaction to Green’s ruling, an appeal is expected — likely to the state Supreme Court because Green’s decision is based on constitutional issues.
