Teacher accused of assault resigns

CAPE GIRARDEAU, Mo. (AP) - A southeast Missouri teacher accused of assaulting a student has resigned, but his attorney says the resignation is no admission of guilt.

The Southeast Missourian reports that 32-year-old Cape Girardeau Central High School physics teacher Roman Smith's resignation was announced Thursday.

Smith is charged with misdemeanor third-degree assault. Authorities say Smith was "play fighting" with the student at a downtown parking lot on Jan. 21, wrapped his feet around the student's waist and applied a choke hold that caused the student to lose consciousness.

Smith's attorney, Bryan Greaser, says Smith intends to plead not guilty.
