Waller attorney seeks to have detention revoked

CAPE GIRARDEAU, Mo. (AP) - A southeast Missouri man suspected in the disappearance of his wife is asking a judge to let him out of jail.

Clay Waller's federal public defender filed a motion Monday to revoke Waller's detention order.

Last week, Magistrate Judge Lewis Blanton ruled Waller should be kept in custody until his trial on a federal charge of making threats over the Internet.

The Southeast Missourian reports (http://bit.ly/qIu7nF) that Waller's attorney argues in the motion that prosecutors did not establish a clear case for detaining Waller.

Waller has been called a suspect in the June 1 disappearance of his wife, Jacque, who was last seen at his home in Jackson. He's being held on charges that that he threatened on the Internet to kill his wife's sister.
