Attorneys: Bustamante's rights violated

March 19th, 2011 in News

Alyssa Bustamante's lawyers want Presiding Cole County Circuit Judge Patricia Joyce to prevent prosecutors from using "any and all statements" Bustamante made to "law enforcement officials, that prosecutors intend to use at her trial."

Bustamante is charged with first-degree murder and armed criminal action in the Oct. 21, 2009, killing of Elizabeth Olten, 9 - her neighbor along Lomo Drive (Route D) south of U.S. 50 in St. Martins.

Public Defenders Donald Catlett and Charles Moreland filed a three-page motion Wednesday to suppress statements Bustamante made to lawmen during the 2009 investigation. Joyce said after a closed hearing that she's taken the issue "under advisement."

Wednesday's hearing was closed to the public, including reporters. The court released a copy of the motion Friday.
