JC man found not guilty of rape, burglary

A Cole County jury this week found a Jefferson City man not guilty of charges of first-degree rape and first-degree burglary for an incident that occurred in March 2014.

Dana Day Jr., 24, 126 Marshall St., is still facing a charge of resisting arrest from when he was taken into custody in May 2014.

Court records show that in March 2014 the victim claimed Day threatened to break her jaw when he came into a residence in the 800 block of East High Street and forced her to have intercourse.

"I am very confident that the jury made the right decision because there was not evidence to convict Mr. Day," said Assistant Public Defender Walter Stokley. "While I do not believe that the woman who was alleged to have been the victim in this case was raped, it is still important that her privacy be respected."

Day was ordered to appear Wednesday before Cole County Judge Dan Green on the resisting arrest charge.

In that case, the police department's Community Action Team and patrol division received information Day was possibly in a neighborhood on the city's east side. Officers attempted a traffic stop on a vehicle Day was believed to be a passenger in. Before the vehicle came to a stop, Day fled on foot and was pursued by officers.

A perimeter was immediately established and the department's K-9 was allowed to track the subject from the traffic stop. Moments later, K-9 Buzz located Day in an overgrown area behind a residence in the 300 block of Jackson Street where he was taken into custody.
