Mo. lawmakers want to nullify federal gun limits

JEFFERSON CITY, Mo. (AP) — President Barack Obama’s call for greater gun restrictions is being met with opposition in the Missouri Legislature.

Obama called upon Congress on Wednesday to ban assault weapons and high-capacity ammunition magazines as part of a sweeping package aimed at reducing gun violence.

But at the Missouri Capitol, Republican state Sen. Brian Munzlinger filed legislation Wednesday that attempts to nullify any federal law restricting semiautomatic guns and accessories. Munzlinger’s bill would make it a felony for federal agents to try to enforce a ban on guns that are made and remain in Missouri.

A similar bill was filled Tuesday by Republican Missouri House member Casey Guernsey. It’s co-sponsored by more than 60 representatives.

Some Democratic lawmakers say the bills are a waste of time, because federal laws supersede conflicting state laws.

And the Constitution supersedes illegal Federal Laws. It's a shame we have to keep telling the Democrats that. Could be that's why there are so few of them at the State Capital these days.

Even so it's good to have some laws already in place. So when the Feds overstep their authority it can be answered swiftly. Rather than trying to enact legislation. Better to be proactive than reactive.

Don't you get it. Assault rifles are for killing people. Real Missouri hunters can use shot guns and rifles for shooting deer, turkey, pheasant, etc. We don't need assault rifles in Missouri. We need this assault ban in Missouri. Spartan62

The Second Amendment doesn't have anything to do with semi-automatic weapons and high capacity magazines either. It has to do with state militias. "Well regulated" militias, I might add.

Erm-hmm. There was something in a 2008 SCOTUS decision concerning gun ownership restrictions in Chicago that said basically that the second amendment guarantees private ownership of firearms. That whole bit about "a well regulated militia" is only posturing in the face of that decision. A person can be a militia of one, and at the same time a corporation of many ones is a single person. Makes total sense.

How will anti-abortion regulation jive with corporations as persons and them divesting (aborting) a subsidiary? They are people now, after all.... I know that's a segway into something else totally.

It has been determined by the highest law of the land that existing federal & state regs meet the criteria for a militia of one to be considered "well regulated", and that the Amendment doesn't specify what are "arms", so really, it should be okay for anyone to own anything the military might also have access to.

A cop spraying a civilian exercising their first amendment right isn't assault. A civilian spraying a cop for violating someone's first amendment rights is. Does that make sense?

I'm rambling. Sorry.

Talk about armchair Constitutionalists. Let's add in amateur revisionist Historians as well.

ALL Men are part of the militia between 15 and 47 (the top age varies a bit from place to place).

And the Second Amendment is about military small arms being available to said militia, even mandatory that any male in the militia makes sure he owns one. Military suitable for what ever period. Unlike Liberal/Feminist ideology the Constitution is forever.

And how many of you " gotta have my assault rifle so I can maintain a well regultaed militia" types are suiting up for military service right now...cause contrary to popular belief...foklks we got a few shootin wars that have been going on for over ten years now and quite frankly the folks that have been dealing with this stuff are burned out and need a break. So if your reeeeeeally into that regulated militia stuff....Uncle Sam needs you now, so come sign on the dotted line and we can have you in War Zone "regulating your militia" real fast. I gurantee we can have you in a fire fight sooner than you expected. Come on dont't be afraid...or is all MACHISMO you spoutin a bunch a talk!!!!!! I mean here's a real chance to do all the Militia regulating you keep shoutin about!!! Come on step forward...I'm sure there's a military person that would gladly swap places with you right now......they'd also be glad to obide by the President's directives and you could take their place in the war zone regulating your milita. Actually my question has already been answered because any one who had any contact with the military would know the militia is for defensive purposes to be called up when needed. A main reason why the National guard is not a true militia and is typically Federalized when used over seas.

But we won't let the facts get in the way of our sinister emotional response all in the hopes of disarming others and leaving them defenseless.

Why would some people want others defenseless I wonder?

Yeah I did my bit too. Glad we both made it out alive...but what I don't understand is why you can't see the President isn't forcing his will, he's only trying to help. None of what he is asking for can happen unless Congress approves it....no large capacity mags, no assault weapons, mandatory back ground checks, somehow I don't see that as violating the Constitution. He's actually calling for more Police Officer's to help patrol the schools, So tel mel how that BS NRA add about him being an elitist hypocrit is true. He's calling to get more properly trained securiry for schools, how does the NRA figure he wants his kids protected more than the normal kid? My point is this...the man is trying to help stop anymore shootings... the NRA and few other's are trying to turn this into "the black guy want's to take away our gun's" issue...and buddy that's a crock of Pooh!

Look if ya don't like the guy then just say...but don't hide behind some misguided, fake, irrational idea of him violating your Consitutional right....cause nothing could be further from the truth

Per capita this is Jeff City...home of nothing happening...but mud runs, a raft trips. Sure the bigger cities...the Lou, KC, Springfield have their share of gun violence, but nothing like Chi-town, Camden, NYC, Miami, Hotlanta a many other's...so why does person in Caruthersville need an AR-15 again? Why does someone in Fulton need a Glock handgun with a 20 round clip? Why does someone in Hallsville need a M2 again? Dude you can own a gun, but all we're (the President included is asking for is sensible laws to hep protect us all. Would it help knowing that the Vice President is asking for the same thing? Perhaps it might be easier to accept the proposal knowing that a white guy agree's with this same common sense approach to gun laws?

First off judging by the hostile legislation VP Bye-Then has endorsed I would never go so far as to claim he is a male. If it is then it should have paid for a change operation some years ago.

secondly you have no right nor the knowledge of other people's lives to dictate what they need and don't need. Rural residents, farmers, ranchers etc. all may have a need for any type of firearm depending on location and the threat(s) they face. From rustling of livestock, stealing hay, vandalism, home invasions, feral animals. You name it.

I can remember at least one article about all of the above scenarios happening just around Central Missouri in the last six months.

Ever seen a calf or sheep attacked by feral dogs? Ever tried to stop such an attack? Wanna try it with a bolt action?

You want gun control? Then practice it in the cities against those who violate the laws and use firearms illegally. Don't try and tell me what I need and don't need or hold me accountable for the actions of others and call me racist when I disagree. Black or White you don't live or know what everyone needs.

The neighbors had a coyote killing last weekend (I was otherwise engaged on the farm but could hear the gunfire.) Did not sound like semi-automatics were being used. Probably some deer rifles and such. They think they got the entire pack of 6 or 7 animals.
