Lawsuit says Zesto trademark violated by older drive-in

A lawsuit hopes to have a chilling effect on the ability of a Jefferson City Zesto Drive-In to sell its ice cream and other treats under the Zesto name.

Ring & Ring LLC, owned by former Zesto South owner Bruce Ring Jr., filed suit Tuesday in Cole County Circuit Court alleging that the Zesto at 501 Broadway St. does not have the legal authority to use the Zesto trademark.

I've got news for Bruce Ring, there are Zesto Drive-ins and walkup ice cream stands all over the US, his business was not the first. But, his lawyers will make a fine mess of cash pushing him to procede with the idea.
