Charge dropped against driver in fatal shooting

Charges against one of the two men believed to be involved in the killing of a man in an Apache Flats mobile home park last month were dismissed Thursday.
Rafel Fuentes, 23, California, Mo., had been charged with second-degree murder and hindering prosecution.
Prosecutor Mark Richardson said Thursday the charges were dismissed in open court, during Fuentes’ already scheduled court appearance in front of Associate Circuit Judge Tom Sodergren.
“The evidence, as it became more fully developed, showed that a single shooter acted alone in this incident,” Richardson said.
Jose Hurtado, 22, California, still is facing a second-degree murder charge in the Dec. 18, 2011, killing of Francisco Navarro. Hurtado remains in the Cole County Jail on a $500,000 bond..

This makes no sense. Even if Hurtado is the "single shooter", Fuentes still drove the get away car and left the wounded man there to die. He still committed a crime and yet he gets off scott free? This makes no sense. Where is the justice?

I doubt he is getting off scott free...there has to be more to the reasons behind letting him go...I am sure that justice will prevail in the end

Fuentes was already on probation for a firearms violation, shooting into a policemans home, and they let HIM go!!!! Who owned the gun. The car belonged to Fuentes!! Sounds like someone was set up to take the fall for everything. My fear is that the actual facts will never come to light. Not in Hurtado's nature to intentionally hurt anyone. There is ALOT more to this than meets the eye, in my opinion.
