LU employee cases sent back to lower court
Wednesday, May 18, 2011
Two men whose 2009 lawsuits against Lincoln University’s curators were dismissed by a circuit judge may yet have their day in court.
A three-judge state appeals court panel in Kansas City ruled Tuesday that Cole County Circuit Judge Patricia Joyce wrongly dismissed the men’s two cases in August 2010, and — in separate opinions — ordered both cases sent back to her.
Carl Kixmiller and Felix Edoho both hired the same Columbia lawyer, George Smith, who filed separate lawsuits in October 2009, accusing LU’s curators of failing to handle the men’s job complaints correctly.
