Cole County Prosecutor Mark Richardson apparently decided not to challenge an order suppressing some of the evidence in the Alyssa Bustamante case.
Bustamante, 17, faces first-degree murder and armed criminal action charges for the Oct. 21, 2009, murder of neighbor Elizabeth Olten, 9.
A review of court files Wednesday afternoon showed no record of an appeal being filed. But Bustamante's lawyers did meet their deadline for notifying prosecutors of witnesses they might be calling during the first-degree murder trial.
