The Missouri Supreme Court is to consider who should have custody of a boy whose mother was caught in an immigration sweep and claims she never agreed to an adoption.
The high court was to hear arguments Tuesday in the case of Encarnacion Romero. The Guatemalan woman was jailed in 2007 after an immigration sweep at a southwest Missouri poultry plant.
Her son, now nearly 4 years old, was adopted in 2008 by Seth and Melinda Moser of Carthage.
Romero pleaded guilty to aggravated identity theft and was sentenced to two years in prison. She has been seeking custody of her son since getting out of prison.
A state appeals court ruled earlier that Romero should have custody.
