Jefferson City Council prepares to sue over surtax

In a unanimous vote of the Jefferson City Council, plans were made Wednesday night for the city to file a lawsuit against Cole County to recover five years‚ worth of improperly-distributed surtax funds.
The motion, which was written by City Attorney Nathan Nickolaus and made by 3rd Ward Coucilman Bob Scrivner, instructed Nickolaus to file suit if the agreement is not signed by the county and returned to the city by 3 p.m. today.
While discussing the potential litigation, Nickolaus informed the council that he wrote the language for the lawsuit such that the city would be able to recover five years worth of the surtax funds.

How much in legal fees will this cost the taxpayers of both the city and the county? No matter the outcome, the taxpayers lose and the lawyers win.
