Committee still chasing E.coli information

Requests to interview DNR employees hit snag

Published: Friday, August 28, 2009 2:49 PM CDT
The Missouri Senate committee looking at apparent problems with reporting E.coli bacteria levels at the Lake of the Ozarks this spring seemed to have more questions than answers, during an hour-long telephone conference call Friday morning.

All are agreed on the problem -- the state Natural Resources Department in June waited a month to release testing data it normally releases more quickly.

That data showed higher-than-normal levels of the bacteria in the Lake's waters.

The department later said it wanted to determine if excessive rain run-off had caused the elevated levels.

But the department's State Parks Division shut down two public beaches during the same time period, based on results from a different set of tests -- saying the bacteria levels were too high for swimmers to be safe in the Lake.

Brendan Cossette, a lawyer who works for Senate President Pro Tem Charlie Shields, R-St. Joseph, told committee members on the conference call they've received "about 200,000 pages of documents so far," including e-mails sent or received by 19 DNR employees.

However, he added, requests to interview informally a number of DNR employees has run into a snag, with the department's general counsel insisting that department lawyers also be involved in the interviews.
