Prosecutor: No crime in deputy's actions

According to Patrol Sgt. Jason Clark, Deputy David F. Barrett, 46, Jefferson City, shot Clifton Walker,18, Fulton, once in the left upper arm with his .40 caliber service weapon.
“It doesn't appear that there was anything criminal in his actions,” Clark said on Monday.
Clark also said then that ballistic tests needed to be completed and submitted to the prosecutor's office for review.
On Wednesday, Richardson issued a statement that no criminal charges would be filed in the case against Barrett.
"Investigators ... conducted a thorough investigation which included interviews of all witnesses and all deputies on the scene at the time of the shooting," Richardson noted. "I have reviewed the patrol's findings with the lead officers who conducted the investigation and see nothing to suspect or suggest any crime by the deputy's use of force in this instance."
Criminal charges of domestic assault in the third degree are pending against Abe Walker, the prosecutor's office reported.
