Missouri man sentenced to 7 years in boy's death

BOONVILLE, Mo. (AP) - A mid-Missouri man draws a seven-year prison term for killing his girlfriend's 5-year-old son because he was angry the boy was vomiting and had diarrhea.

Cory Gaddy was sentenced Monday in Cooper County Circuit Court after entering an Alford plea to a charge of first-degree manslaughter. Under the plea, the 32-year-old Bunceton man did not admit guilt but acknowledged the state had enough evidence for a conviction.

Gaddy was initially charged with second-degree murder in the June 2006 death of Colby Bolte.

Witnesses had testified that Colby and his then-2-year-old sister had suffered months of abuse.

Cooper County prosecuting attorney Doug Abele says the victim's family was in favor of the disposition of the case.

" That's the tragedy of domestic violence. It's a double edge sword. They are scared to stay and they are scared to leave because they are usually threatened that if they leave the kids, their family, and even them would be killed. So they stay. It is an outrage that this man only got 7 years and did not plead guilty to the ACTUAL act, just that there was evidence he would be convicted. The mother is still waiting for her day in court. Whatever the sentence I hope she gets help, because these women are abused physically and emotionally. I am sure she is devastated that she has lost both her children. "

" you see Sam, that's the part I don't understand. Scared to leave? How about scared to stay. When your child is in a harmful situation, if you were really concerned about the child wouldn't you get him out of harms way? As a mother you would think that would be the first instinct.
But then I hear of parents getting out of a burning building and leaving their children to perish and I don't understand that either, if mine died I would too.
The lack of punishment here though is an outrage. "

" cont. Without knowing the full details of everything we shouldn't automatically judge and assume that she was a bad mother. Wonderful mothers stay in these situations everyday becuase they are scared for their children, their family, and their own lives. So, eventhough we don't agree with her decision to stay does not mean we should condem her to death. Violence in the home isn't the easiest thing for them to walk out of. She should still be held responsible for not getting out sooner, but she should not be condemned to death. Remember she lost a child, and she will have to live with that for the rest of her life. And it will haunt her for the restofherlife. "

" Ok, I have to say my piece. First of all the mother was not on drugs and getting sex. Believe it or not she was scared to death for her life and her children. I do agree that she did have a responsibility to her children, but just because she stayed does not mean that she didn't care about them, that she was getting sex and getting high to allow this to go on. You're right this does happen everyday, but not all women in this situation stay due to drugs and sex. They stay out of fear. We will never know the details, and I do believe that the mother should still have to face the consequences. "

" AT least we know what a child's life is worth in Bunceton. And the mother, apparently was getting sex and drugs so she could have cared less about the kids. The boyfriend should have gotten the death penalty and the mother at least as much. Anything less is just that less. Those in the business knows this goes on everyday in this state. Male cowards abuse and kill innocent children while the mothers allows it. Lets wait and see how long it is before someone defends them on this post. "

So, recurring abuse that eventually leads to the death of a child gets a manslaughter charge? 1980mom is exactly right- let the punishment fit the crime. And in neither case does it. All child deaths, intentional deaths or those as a result of abuse, should automatically be sentenced to death and the defendant should have to argue mitigating circumstances for something other than death during the penalty phase. A conviction should equal death, unless proven otherwise. I'm not always for max or mandatory punishments upon convictions, but in the case of child deaths I will make an exception. "

" There is something morally corrupt with a person that kills a child. There should be NO punishment except death. If it were up to me, it would either be death in a similar fashion as how they killed the child or even something more painful.

I hope the rumors you hear about child abusers being mistreated in prison is correct and this man does not live to see the day he is released from prison! "

" How DID the mother and the family get off without, at least, secondary charges here. And how does a murderer get a manslaughter plea!
Until people become outraged and vocal to their prosecutors and judges this will continue. Children will be abused and killed and the pinheads will continue thier nonchalant treatment of these cases.

I'm going to make it a mission to write to this prosecutor and judge and let them know this is unacceptable. "

" This really bothers me, simply because BEFORE I read this article I read one about a Columbia man that was sentenced to 6 years for exposing himself to undercover officers in an internet chat room. And then for killing a child, this individual only gets 7 years. THAT is VERY, VERY disturbing to me! Speaking for myself, AS a mother, in my opinion THAT is not justice! And I also agree that the mother of these two children should face severe punishment, a mother is to protect her children, be there for them, and be always concerned with their safety and well being - she failed her children - and in the worst way, she is NOT innocent here. "
