JCPD makes two DWI arrests at checkpoint

Published: Monday, August 25, 2008 4:03 PM CDT
Jefferson City police officers stopped 181 vehicles during a DWI checkpoint Saturday night.

According to police reports, officers worked from 10 p.m. to 2 a.m. in the 1000 block of Madison.

During this time, two DWI arrests were made. One of those arrested was attempting to avoid the checkpoint.

In addition, 43 other violations were noted, including two arrests for suspended or revoked drivers' licenses.

Funding for the checkpoint came from a grant from MoDOT's Division of Highway Safety.

This checkpoint coincided with the national “You Drink, You Drive, You Lose” campaign

JCPD plans to conduct a saturation patrol before the national campaign ends on Labor Day on Monday, Sept. 1.

" Heck, they might as well set up a checkpoint to catch the morbidly obese as they pull out of McDonalds too. "

" The DWI problem is a big one.Stopping every so many autos is just a reason to run some tactics that are truly unfair to our democracy. They would arrest just as many DWI's if they saturated the roads and highways with the same manpower.People have that good feeling when they happen to catch;driving without a license, insurance, registration violations and all those catches they get while looking for the dreaded DWI.Why don't they setup where people leave Wal-Mart and catch the same number as they get on the highway at 11:00 PM those nights.Alot safer and easier.Or stop them before they go to Wal-Mart, then you will see the checkpoints stop!! "

" Byron - You are 100% wrong! Read the Supreme Court decision that allows the use of checkpoints, they admit in their decision that is a violation of unreasonable search & seizure, but they allow it for the "greater good" of public safety. It is a violation of civil right and the court admits it in their decision. Case closed.

Following this check point of, I think, 1% success rate. Osage Beach held 2 checkpoints in one night and the total success rate was .5%. So we are going to allow the violation of 99.5% of citizens' rights to catch .5%? Unacceptable in country that prides itself on it's citizens rights and freedoms. "

Yeah, right. If they stops are illegal why are thye not thrown out? The answer is that they are legal. "

" that announced this DWI checkpoint over the PA system. Of course, they have to publish the checkpoints somewhere, in the newspaper I think. So if the newspaper announces it, all bars and cell phone users should be able to announce it. "

" Ah, byron, you are wrong on the no violation of rights idea. The violation is called illegal search and seizure. When they have a checkpoint, the look at everybody in the car. What is the point if it is in fact a DWI checkpoint. Why take people in for other violations? If I am not driving, they have absolutely no right to ask for my ID or ask me who I am. They have absolutely no right to search the car without a warrant, or probably cause. DWI is not probable cause. (I don't know if they search cars for sure, but am pretty sure they do.) It is true though, that everybody knows where it is. I was in a bar..continued... "

" Byron,
Guess what I found out by civil right$$$$$ Attorney he's friend my oldest son dates his daughter. When the police don't protect are residental streets & business streets.IE: Stabbings,Robberies,Home-invasions.

If a incident happens in your home, the police are assigned certain post(jurisdiction) County or city. The officers can't justify in court why they could not respond in reasonable amount of time to prevent futher injury from being victimized, death etc. They can be held legally responsible in Federal Court Lawsuits.
These officers That are suppose to be patrolling our streets are leaving us hanging.when something bad happens that they are too late or don't respond to justify there actions? Bam No job, no home, bye bye RoadNazi. lol "

JCpatriot wrote on Aug 27, 2008 8:58 PM:

" Gofish & ODF,

Your both right, JCPD has there priorities messed up. I'm told alot? The p[roblem starts with there current adminstration. I think they need to concenrate on patrolling the city streets risdental & business are being ignored. Whats scary the Burgulars know it.

The problem is there sitting on the main roads & highways most of the time? I guess speeding tickets are more important than the public resident safety? "

boscoe wrote on Aug 27, 2008 1:52 PM:

" Doesn't matter if they catch the DUI offenders anyway. Due to the "Hug-A-Thug" program that the local courts are running, they will be out driving the next day anyway.

I agree that this is a huge waste of tax dollars at best, and most likely a violation of "innocent until proven guilty" - police abusing their powers to harrass the citizenry.

Criminal justice in this community is plain nuts.

Confessed child molesters are set free, and multiple offenders are just given more probation everytime they continue assaulting, stealing, raping, burglerizing, or driving under the influence. People convicte of murdering infants are only given a few years of incarceration. "

ODF wrote on Aug 26, 2008 2:37 PM:

" I agree gofish. I think it's a lot of squeaky wheel syndrome...and MADD is about as squeaky as it gets. Yet those people that do complain are hammered on by others about being "haters" and "complainers" and need to move, etc., yet time-and-time it's shown that the squeaky wheels are the ones that get greased.

Only 50% of all accidents +/- are attributed to drunk drivers, yet there is so much focus. What is being done to focus on the 50% of accidents caused by sober drivers that are speeding, careless, eating, playing with the radio, talking on cellphone, distracted by their kids, etc.? "

gofish wrote on Aug 26, 2008 2:02 PM:

" It's a shame that this kind of time and manpower couldn't have been spent solving a murder, a vicious assualt on a teen girl at Hyvee, a rash of vehicle breakins, etc, etc.

JCPD has their priorities SOOOOO out of focus.

Even the police will admit these checkpoints are mostly unproductive and only serve as a deterrant, although I'd be interested to see some real numbers from a bonifide, credible research group to prove that even a deterrant is a result. I firmly believe that DWI Checkpoints DO NOT prevent future drunk driving episodes. And besides, once the checkpoint is discovered the word gets out quickly via cell phones and texting of its location and the "real" DWI'ers avoid the area. "

ODF wrote on Aug 26, 2008 12:55 PM:

" I agree with everything you said 2206. The other thing I find unacceptable is that the court-allowed DWI checkpoints are being used as a catchall to see what they can find. It's not uncommon for police to check everyone in a vehicle for whatever they want. "

2206 wrote on Aug 26, 2008 11:45 AM:

" Driving while drunk is not acceptable, however police stopping 181 citizens with no probable cause, is totally unacceptable. This practice concerns me as to what is next? "

ODF wrote on Aug 26, 2008 9:52 AM:

" Lovely...violate the Constitutional Rights of 99% of the people to catch the 1% that are in violation. "
